Acceptable Use Policy

This Acceptable Use Policy (“Policy”) is part of our Terms and Conditions (“Legal Terms”) and should therefore be read alongside our main Legal Terms: https://info.dateabilityapp.com/terms-conditions/. If you do not agree with these Legal Terms, please refrain from using our Services. Your continued use of our Services implies acceptance of these Legal Terms.

Please carefully review this Policy which applies to any and all:

uses of our Services (as defined in “Legal Terms”)
forms, materials, consent tools, comments, post, and all other content available on the Services (“Content”) and
material which you contribute to the Services including any upload, post, review, disclosure, ratings, comments, chat etc. in any forum, chatrooms, reviews, and to any interactive services associated with it (“Contribution”).

We operate the website https://dateabilityapp.com (the “Site”), the mobile application Dateability (the “App”), as well as any other related products and services that refer or link to this

User Registration and Obligations

If you choose to register and become a user of our Services, you agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change any username and/or your password you select if we determine, in our sole discretion, that such username is inappropriate, obscene, otherwise objectionable, or compromised in any way.

By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Services or the Site through automated or non-human means, whether through a bot, scripts, or otherwise; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use of the Services will not violate any applicable law or regulations.

If you provide any information that is untrue, inaccurate, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

User Content

The Services may allow you to chat, contribute, or participate in blogs, message boards, online forums, and other functionality, and may provide you with the opportunity to create, submit, post, display, and transmit content and materials to us, on the Services, or within the Services (collectively, “Contributions”). Particularly if you are a user of the Services, the information you submit may include personal information as detailed in our Privacy Policy. Your Contributions will be viewable by other users of the Site and the Services. As such, Contributions you transmit will not be treated as non-confidential and non-proprietary, unless noted otherwise in our Privacy Policy. For any Contributions, you agree to comply with our Acceptable Use Policy which is available here and incorporated herein by reference. You further warrant that:

You own and have created and own any licenses, rights, consents, and permissions to use and authorize us to authorize us, and others to use your Contributions in order to provide the Services.

Our distribution, public display, and other use of your Contributions will not infringe the proprietary rights of a third party.

You have obtained the consent from any person in any photos or other Contributions you submit.

Your Contributions are truthful and not intentionally misleading.

You will not submit any Contributions that are obscene, lewd, lascivious, filthy, violent, harassing, or otherwise objectionable (as determined by us in our sole discretion).

You will not submit or take any actions that could harass, abuse, threaten, ridicule, or otherwise offend any other user(s) of the Services.

You will not post Contributions that are unauthorized advertising, promotional materials, or other forms of solicitation.

You will not post Contributions that violate applicable law or the privacy rights of another party.

You will not post any Contributions that violate child pornography laws, or otherwise threaten the health or well-being of minors.

You will not post any Contributions that offensively refer to race, national origin, gender or gender identity, sexual preference, disability, or chronic illness. You will not post Contributions that violate, or link to material that violates, any provision of these Terms, or any applicable law or regulation.

Any use of the Services in violation of the foregoing violates these Terms and may result in, among other things, termination or suspension of your rights to use the Services or access the Site.

Restrictions on Use; Prohibited Activities

You may not access the Services for any purpose other than to receive the services or interact with the Services. As a user, you agree not to, directly or indirectly, or to cause or allow another party to:

Systematically retrieve data or other content from the Services to create or compile any collection of the same, without our express written permission.

Mislead or defraud other users.

Circumvent or disable security-related features of the Services, including, without limitation, features that prevent or restrict the use or copying of any Content.

Disparage, tarnish, or otherwise harm us, our users, or the Site or Services.

Obtain information or use the Services for the purpose of harassing, abusing, intimidating, or otherwise annoying or harming another person.

Obtain information to submit false or misleading reports of abuse or misconduct.

Use the Services in a manner inconsistent with applicable laws or regulations.

Engage in unauthorized framing or linking to the Services.

Upload or transmit any malware or other harmful material that interferes with any party’s uninterrupted use and enjoyment of the Services or Site or interferes with the use of features and functionality of the Services.

Any data mining or similar activities.

Make unauthorized use of the Services such as by creating user accounts by automated means or under false pretenses.

Use the Services as part of any effort to compete with us or otherwise use the Content for any revenue-generating endeavors or commercial purposes.

Use the Services to advertise or sell goods and services.

Sell or otherwise transfer your profile.

Use language or imagery that could be deemed discriminatory towards a person’s race, ethnicity, national origin, religion, disability, sexual orientation, gender, gender identity, gender expression, or physical identity.

Use language or imagery that could be interpreted as offensive or could constitute harassment.

Use or send content that is obscene, pornographic, or violent.

Use language or send content that is abusive, insulting, threatening, discriminatory, or promotes hatred or bigotry of any kind.

Use language or send content that is harmful to minors.

Use content that shows another person which was created or distributed without that person’s consent.

Impersonate another person or use a false identity.

Use language or send content that is defamatory or libelous.

Encourage illegal activity of any kind.

Misrepresent your age or identity.

Disclose information without permission.

Harass or stalk any Dateability user.

Dateability is committed to creating a safe and respectful environment for all users. We do not tolerate any form of harassment, sexual violence, stalking, or any conduct that threatens personal or public safety, whether on or offline.

Safety

DATEABILITY DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS OF IDENTITY VERIFICATION. DATEABILITY DOES NOT CONTROL WHAT OUR USERS DO OR SAY. YOU ARE RESPONSIBLE FOR YOUR USE OF OUR SERVICES AND YOUR INTERACTIONS WITH OTHERS. DATEABILITY MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT, IDENTITY, INTENTIONS, LEGITIMACY, OR VERACITY OF ANY USER ON OUR PLATFORM.

We reserve the right, in our sole discretion, to perform a public records screening for criminal history (“criminal records screening”) on any users. Your use of our Service is at your own risk.

We offer optional profile verification. In some cases, we may request a user verify their profile if we suspect the account is inauthentic. No online verification is foolproof nor can it guarantee that a user is safe. Always remain cautious when communicating with a person online or in-person.

Individuals that have been convicted of or pled no contest in sexual or violent crimes are prohibited from using our Services. If we become aware that a user has a criminal history that makes them ineligible to use Dateability, we will ban them.

Reporting Users

If you encounter suspicious or inappropriate behavior, you can report a user by clicking on the Report/Block button on the profile and including any additional details in the submission form. You can also report a profile by emailing [email protected]. Reported profiles are promptly reviewed and appropriate action is taken.

Submitting false reports for malicious, biased, or other illegitimate reasons is a violation of our Terms and can result in action being taken against your account.

In compliance with Colorado law, we will send email notifications to Colorado users who have exchanged messages with a member who we have banned due to known or suspected fraudulent behavior. “Fraudulent behavior” is behavior that, in our judgment, indicates the user poses a significant risk of attempting to obtain money (or something of value) from other users through fraudulent means, by using a false identity, or by attempting to defraud other users.

Otherwise, as provided in our Privacy Policy we can only disclose a user’s account information in limited circumstances, such as when it is the subject of a lawful subpoena or warrant or otherwise required by law.

Users have the right to appeal actions taken against their account by emailing [email protected].

Resources/Safety Tips

No Guarantees. We don’t have a quiver full of Cupid’s arrows.

While we can’t make any guarantees for love at first sight – we are confident that most users will learn and benefit from using our Services, and even make you more comfortable in your dating – and social – journey. We even think that our Services will improve your chances of finding that special somebody. However, we don’t make any guarantees. We are not Cupid, nor do we have his special arrows.

Given the complexity of human nature, the challenges of interpersonal relations, and other constraints, we do not provide any warranty that our Services will result in a specific timeline, general cadence of dating (e.g. multiple dates per month), or that you will find that special person using our Services, or even that you will be satisfied.

Indeed, even when using our Services, you may find that a suitable match is not available for you based on your required preferences, interests, and values. Moreover, if you do go on a date, understand that we cannot control how you or our other users may behave or discern anyone’s veracity or true intentions. If there is a spark and that first date leads to a second date or romantic relationship, we are also, of course, not able to control how the continued relationship unfolds and where it may lead. We are just the first step – the rest is up to you and the other users with whom you connect and interact.
